Owen’s legal practice has focused on the business aspects of Indian law. He has advised tribal members, staff, and leadership on a wide variety of projects and issues.   From devising tribal policy, to assisting the execution of a multi-million dollar capital project, Owen has provided counsel on the most complex issues facing Indian nations today. The following is a cross-section of some of the projects upon which he has advised.
  • Served as a key member of the legal team that handled the arbitration of a complex gaming compact dispute between a State and Indian nation, including the negotiation of successful settlement on behalf of the tribe in excess of nine figures.

  • Represented tribal interests in the financing transactions of a tribally-owned gaming corporation, cumulatively valued in excess of $1.5 Billion.  Specific areas included management of due diligence process, drafting of necessary disclosures, and negotiation and drafting of owner agreements and covenant structures.

  • Collaborated with senior management of a tribal gaming company in the development and construction of new/expanded gaming facilities in three locations, valued in excess of $1 Billion.

  • Developed a separate, wholly owned/controlled financing entity for an Indian tribe, which then issued $160 Million in taxable and tax-exempt bonds for the purpose of capital projects and infrastructure development on tribal territories.  This was accomplished with no recourse to the tribe’s assets.

  • Provided legal counsel related to the design and construction of over $200 Million worth of new tribal facilities, including government buildings, community centers, education facilities and water/wastewater/electrical infrastructure upgrades.

  • Provided legal and initial project management support related to the design, development, and construction of wireless broadband infrastructure for the purpose of providing free wireless internet access to tribal members.

  • Established multiple wholly owned companies on behalf of an Indian nation, which included the development of a dedicated economic development holding company, and assistance with 8(a) certification.

  • Provided advice and counsel related to the creation of a 25-unit housing subdivision, from initial land acquisition through execution of the site development and construction contracts.

  • Regularly drafted extensive pieces of legislation for an Indian tribe, from simple resolutions of the Tribal Council to complex statutes, including the development of related regulations and the establishment of the regulatory body created under the law.
